1. Purpose

These Terms of Use define the conditions under which The Big Challenge makes its website available to users. Access is subject to acceptance of and compliance with these Terms. Users who do not wish to accept them must refrain from using the website.

2. Definitions

  • Website: thebigchallenge.com in its various national versions
  • User: any person browsing the Website
  • Member: a user authenticated via username, email and password
  • Content: information published by users (videos, texts, photographs, comments)

3. General description of the website

The Big Challenge offers an annual English contest with prizes for students from level 3 to level 9 in the Benelux and other European countries.

Public area

  • Contest registration for teachers
  • The "The Big Challenge PLAY" app to improve English
  • Contribution areas (photos, testimonials)
  • Information on the rules and results

Private area (after authentication)

  • Viewing results
  • Downloading certificates
  • Access to previous scores

4. Access to the website

4.1 Access conditions

Access is free but means the user bears the hardware, software and Internet costs. The Big Challenge recommends changing the password regularly. If forgotten, a new password can be regenerated. In the event of theft of the username and/or email address and/or password, the user must contact The Big Challenge immediately, which cannot be held liable.

4.2 Availability of the website

The Big Challenge undertakes to ensure accessibility 24/7, but reserves the right to close access temporarily or permanently without notice for maintenance or technical issues. The Big Challenge cannot be held liable for any unavailability.

4.3 Minor users

Minors may use the website with parental authorisation. Holders of parental authority guarantee the minor’s compliance with these Terms.

5. Intellectual property

5.1 The Big Challenge’s rights

The website, its domain name, trademarks, logos, software, content and graphic elements are the exclusive property of The Big Challenge. Any unauthorised copy, reproduction, representation, adaptation, alteration, modification or distribution constitutes infringement.

5.2 Users’ rights over their content

Users warrant that they hold the rights to their content. They grant The Big Challenge a free, worldwide licence to use, reproduce and distribute it. Users undertake to indemnify The Big Challenge against any claim based on their content.

6. User obligations

Content must not be:

  • Vulgar or offensive
  • In breach of the personality rights of others
  • Incitement to hatred, violence, racism or discrimination
  • Of a paedophilic or pornographic nature
  • Insulting, disparaging or defamatory under the law

The User expressly authorises The Big Challenge to use the published Content, including photographs, on all types of media free of charge. Users may modify or delete their content by email to info@thebigchallenge.com. The Big Challenge is not responsible for risks of misuse or hacking.

7. Liability of The Big Challenge

7.1 Liability for user content

The Big Challenge acts as a mere host. It carries out no prior review of content and only the User is responsible for the Content they publish. Takedown requests must be sent via the "Report inappropriate content" tab or to info@thebigchallenge.com. 7.2 Liability for The Big Challenge information

The Big Challenge does not guarantee the completeness or accuracy of the information published. Users must check the content themselves. The Big Challenge cannot be held liable for damage related to the information provided.

8. Joint-controller clause between schools and The Big Challenge

The Big Challenge and schools jointly collect students’ personal data, placing them in a joint-controllership situation under the GDPR.

The joint controllers undertake to:

  • Comply with data protection regulations
  • The school informs students via its privacy policy
  • The Big Challenge informs via its privacy policy
  • The Big Challenge is the contact point for requests concerning the data
  • Cooperate and share the necessary information
  • Minimise data collection
  • Prohibit any further processing incompatible with the stated purposes

9. Hypertext links

9.1

The Big Challenge exercises no editorial control over linked third-party sites. It cannot be held liable for damage resulting from access to third-party sites.

9.2

Hypertext links to the website are permitted provided they are not for commercial purposes. The author of the link must inform the webmaster beforehand. The Big Challenge may remove any link that does not comply with its editorial policy.

10. Duration and termination

The contract is of indefinite duration. Members may freely terminate their account at any time. The Big Challenge may terminate without notice in the event of a breach of obligations. Termination is notified by email with reasons.

11. Amendment of the Terms

The Big Challenge may amend the Terms at any time. Amendments take effect as soon as they are put online. Users must consult the current version before each use. Disapproving of the amendments means deleting the account.
